Mr. Jim Herron <br /> Page 3 <br /> of total suspended solids or other pollutants discharged into <br /> qround or surface waters as compared to such discharges that <br /> occurred prior to mining or that would occur if the roadways <br /> and mine portal pads were removed. Since all water originating <br /> in Coal Basin, beyond that absorbed by the shallow topsoil <br /> or retained in underground aquifers, eventually makes its <br /> way into Coal Creek and on to the Crystal River, the total <br /> volume of flows from the permit area will not vary in a way <br /> that adversely affects the ecoloqy of any surface water or <br /> any existing or planned use of surface or ground water. <br /> The owners of the surface lands within the permit area are <br /> Mid-Continent Resources, Inc. and the U. S . Forest Service. <br /> This special request by Mid-Continent is offered as proof <br /> that it has "knowinqly requested, in writinq, as part of the <br /> application, that a variance be granted. " The U. S . Forest <br /> Service request is attached as Attachment No. 1. <br /> The proposed reclamation operations will be conducted in <br /> compliance with the requirements of 4 . 27. 4 as herein de- <br /> scribed. As outlined in Chapter V of this permit applica- <br /> tion, all highwalls in the permit area will be backfilled to <br /> the extent possible with all spoil material available in a <br /> manner which results in a static factor of safety of at <br /> least 1. 3 using standard geotechnical analysis. The water- <br /> shed control of the area within which mininq occurs will be <br /> improved by reducing the peak flow from precipitation or <br /> thaw and by reducing the total suspended solids or other <br /> pollutants in the surface water discharge during precipita- <br /> tion or thaw. The total volume of flow shall not be altered <br /> in such a way that adversely affects the ecology of the <br /> surface water on any existing or planned public or private <br /> use of surface or ground water. No land above hiqhwalls <br /> will be disturbed. <br /> Upon receipt of approval of this variance request, the <br /> permit shall be specifically marked as containinq a variance <br /> from approximate original contour. <br /> Sincerely, <br /> Georqe E.
