ffk <br />BLATTNERIT <br />ENERG <br />1/ <br />Responses to the Preliminary Adequacy Review <br />Permit #: NI-2012-013 <br />6.4.4: Exhibit D — Mining Plan <br />1) Blattner Energy, Inc. does anticipate installing rip rap check dams along with rock dam sediment <br />traps. Enclosed with this response packet, please find the Storm Water Management Plan <br />prepared specifically for the 112 permit we are applying for. This plan details the locations <br />where the BMP's are to be constructed and /or installed. Also included in this document are <br />specific details showing how the BMP's are to be built and /or installed. It is important to note <br />that this plan is preliminary and is still in the process of being reviewed and finalized. Before <br />mining activities do begin, the final Storm Water Management Plan will be issued and processes <br />adhered to. This plan will be placed on -site and available to any party who wishes to view it. <br />6.4.5: Exhibit E — Reclamation Plan <br />2) There is a very strong chance that manure will be needed for reclamation to supplement the <br />native topsoil material present at the site. Because of this, Blattner will need to remain aware of <br />any invasive weed species that may become present during and after mining activities. To <br />ensure there is not an outbreak of invasive weed species within the proposed mining site, <br />Blattner Energy has developed a site specific Noxious Weed Control Plan. This plan has been <br />included if with this submittal and will be adhered to throughout the lifespan of the permit. <br />3) Blattner Energy, Inc. recognizes the importance of leaving the reclaimed area undisturbed <br />during revegetation process. By allowing an adequate undisturbed growing time, the <br />revegetation effort has a much higher chance of success. Blattner has spoken with the <br />Landowner about this topic, and the Landowner has agreed to keep cattle off of the area until <br />necessary revegetation has been established. A fence has already been installed to keep cattle <br />off of the area to be mined and will remain in place until revegetation has successfully taken <br />place. Cattle will be kept off the revegetated area for two years unless it is deemed acceptable <br />to allow them back on at an earlier date after consultation with the local NRCS office. <br />6.4.12: Exhibit L — Reclamation Costs <br />4) Blattner Energy, Inc. will acquire the appropriate bond immediately following the bond amount <br />being received from the Division. <br />
