The PBWW water will be provided at the City of <br />Pueblo wastewater treatment plant located east of Pueblo when adequate exchange potential <br />exists to make that replacement water available at the Parkdale Project site. When there is <br />insufficient exchange potential to utilize reusable effluent, the PBWW will release water from <br />upstream storage at Clear Creek Reservoir or Twin Lakes Reservoir, or the applicant may <br />release water from Twin Lakes Reservoir. Upstream reservoir releases will be subject to a 0.07 <br />percent per mile river transit loss, or approximately 6.34 percent from Clear Creek Reservoir to <br />Parkdale, and 6.55 percent from Twin Lakes to Parkdale. Front Range Aggregates also has an <br />additional backup supply for this project from a 50 acre -foot lease with the Canon City Water <br />Department that will only be used in the event that the other sources become inadequate. The <br />Canon City lease, a copy of which was provided to this office on September 12, 2008, is valid <br />until January 2035. The monthly depletions and replacement requirements are provided on the <br />attached Table 3. <br />CONDITIONS OF APPROVAL <br />I hereby approve the proposed substitute water supply plan in accordance with §37 -90- <br />137(11), C.R.S., subject to the following conditions: <br />1. This SWSP shall be valid for the period of October 1, 2011 through September 30, <br />2012, unless otherwise revoked, modified, or superceded by decree. If this plan <br />will not be made absolute by a water court action by the plan's expiration date, a <br />renewal request must be submitted to this office with the statutory fee (currently <br />$257) by August 16, 2012. <br />2. Well permit no. 67722 -F was obtained for the current use and exposed pond surface <br />area of the gravel pit in accordance with §37 -90- 137(2) and (11), C.R.S. <br />3. The total surface area of the groundwater exposed at the Parkdale Project site must not <br />exceed 1.6 acre during the approval period of this SWSP resulting in an annual <br />evaporative loss of 4.51 acre -feet. <br />4. The annual amount of water used at the operation shall not exceed 10.0 acre -foot for dust <br />control and the total product mined shall not exceed 400,000 tons per year above the <br />groundwater surface resulting in 5.89 acre -feet of water lost with the product. <br />5. Total consumption at the Parkdale Project site must not exceed the aforementioned <br />amounts unless an amendment is made to this plan. <br />6. Water used for washing that ponds and does not infiltrate within 24 hours may require an <br />amendment to the plan to included additional acres of exposed surface area subject to <br />evaporation that will require additional replacement under the plan. Field visits by the <br />Water Commissioner will be made to confirm that 0.5 acres of evaporative surface area <br />is appropriate for settling ponds under this plan. <br />7. Approval of this plan is for the purposes as stated herein. Any additional uses of this <br />water must first be approved by this office. <br />
