BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br />IN THE MATTER OF THE APPLICATION OF OLDCASTLE SW GROUP, INC., <br />D /B /A FOUR CORNERS MATERIALS, FOR 112c RECLAMATION PERMIT, <br />File No. M- 2011 -028 <br />THIS MATTER came before the Mined Land Reclamation Board (`Board ") <br />on May 9, 2012 in Denver, Colorado as a consent agenda item to consider a request <br />by Oldcastle SW Group, Inc., d/b /a Four Corners Materials ( "Applicant") to extend <br />the decision deadline beyond 365 days after its application for a 112c reclamation <br />permit was found complete, file number M -2011 -028. <br />The Board, having considered the materials presented with this consent <br />agenda item and having been otherwise fully informed of the facts in the matter, <br />enters the following: <br />FINDINGS OF FACT <br />1. On May 20, 2011, the Division of Reclamation, Mining and Safety <br />( "Division ") found the Applicant's application for a 112c reclamation permit <br />( "Application ") complete. The Application concerns an 127.5 -acre construction <br />materials aggregates operation located in Section 7N, Township 34 West, Range 9 <br />West, New Mexico Principal Meridian in La Plata County, Colorado, file number M- <br />2011 -028. The site is known as the Animas Glacier Gravel site. <br />2. The Division received comments to the Application from other agencies <br />on June 13, 20, and 22, 2011. The agencies expressed a desire to have party status. <br />3. On June 29, 2011, the Division sent Applicant a letter identifying <br />adequacy issues related to the Application, including that Applicant had an expired <br />lease pertaining to legal right of entry. <br />4. On October 19, 2011, the Division received a transfer of Mineral <br />Application and Succession of Permit Applicant application to transfer the permit <br />from Weeminuche Construction Authority to the Applicant. The Division approved <br />the transfer of the Application on November 18, 2011. <br />5. On March 15, 2012, the Division received documents from the <br />Applicant addressing adequacy issues related to the Application. <br />
