Hickenlooper <br />Govemor <br />Mike King <br />Executive Director <br />Loretta E Pineda <br />Director <br />On May 11, 2012, the Division of Reclamation, Mining and Safety ( "Division ") received the above - <br />referenced amendment application'. The Division has conducted a preliminary review of the application <br />in accordance with the Mineral Rules and Regulations of the Colorado Mined Land Reclamation Board <br />for the Extraction of Construction Materials ( "Rules "). Rule 1.4.1(8) requires the Division to notify an <br />applicant of any deficiencies that prevent an application from being considered filed. The Division's <br />review found the following deficiencies that prevent the application from being considered filed. <br />1. Much of the application package that is marked "CONFIDENTIAL" does not qualify for <br />confidentiality because the marked information does not disclose the information specified in Rule <br />1.3(3) as being eligible for confidentiality (location, size, or nature of the deposit or depth and <br />thickness of the deposit and thickness and type of overburden to be removed). Please see the attached <br />letter from our Attorney General on this issue. <br />2. Exhibit L does not contain the information necessary to calculate the costs of reclamation, as required <br />by Rule 6.4.12. <br />The application will not be considered filed until the above - referenced deficiencies are corrected. If you <br />have already published the newspaper notice required by Rule 1.6.5 (1), you will need to republish the <br />notice after the Division considers the application filed. After the application is considered filed, the <br />Division will review the application for technical adequacy (compliance with the Rules and the Colorado <br />Land Reclamation Act for the Extraction of Construction Materials). <br />The Rules provide that you have 60 days from the date of this letter to correct the above - referenced <br />deficiencies. However, please be advised that you cannot achieve compliance with the Mined Land <br />Reclamation Board's June 10, 2009 Order MV- 2009 -012 until you submit a complete, reviewable <br />application.
