GCCE has contracted with Trautner Geotech <br />to evaluate the properties (physical, and chemical) of the coal mine waste that was emplaced as backfill at the King I <br />highwall. If it can be established that the material as placed is in compliance with the performance standards of the <br />pertinent rules, GCCE will submit an application for a Technical Revision to the permit. Conversely, if results show that <br />compliance has not or cannot be achieved, GCCE commits to relocating the CMW to the approved refuse pile. <br />A tentative timeline, based on my discussion with Mr. Bird, is as follows: <br />Field work (drilling and sampling): by June 1, 2012 <br />Laboratory analysis: by June 18, 2012 <br />Preparation of report: by June 30, 2012 <br />Submittal of TR application July, 2012 <br />Within the next few days, GCCE will submit a package to the Division outlining the proposed path to abatement of the <br />NOV. Once the Division receives the information, we can modify the abatement steps of the NOV and extend the <br />abatement date. <br />Marcia <br />Marcia L.
