Project Engineer Western Fuels Association, Inc. 12050 N Pecos Street, Suite 100 Westminster, CO 80234 Re: New Horizon North Mine Application, C- 2010 -089 Transmittal of Objection Letters Received Dear Mr. Anderson: Loretta Pineda Director The Division of Reclamation Mining and Safety has received two new objections (attached) to the proposed decision to approve the New Horizon North Mine application. The objections were received by facsimile on May 18, 2012, and are unsigned, although they indicate they are from Art Hutto and Bode Porter. Section 2.07.4(3)(a) states, "Any person which may be adversely affected by the proposed decision may request a formal hearing before the Board on the proposed decision. Such request must be made within 30 days of the first publication of the proposed decision of the Division, be in writing, and state with reasonable specificity the reasons for the request and the objections to the proposed decision." The first publication of the notice was on Thursday May 10, 2012. Therefore, the public comment period will be open through Monday, June 11, 2012. Any additional objection letters will be transmitted to you as they arrive.
