The 25 Avenue Site was inspected by Peter Hays with the Division of Reclamation, Mining and Safety <br />(Division) in response to an acreage reduction (AR -01) request. Mr. Bill Schenderlein with Blue Earth, the City <br />of Greeley consultant, was present during the inspection. <br />On March 23, 2012, Blue Earth submitted an acreage reduction request on behalf of the City of Greeley for a <br />mile of 30 -foot wide easement along 35 Avenue. The City is in the process of annexing the 25 Avenue Site <br />(Poudre Ponds) into the city. The requested release area is not included in the annexation and will remain as <br />part of Weld County. <br />The Division is required by Rule 4.17.2(2) to inspect the site within 60 days after receiving the notice to <br />determine if the Permittee has complied with all applicable requirements. The approved post- mining land use <br />is developed water resource. The acreage within the release request has not been affected by mining <br />activities and will not be affected in the future. <br />The Division received comments related to the acreage release request from Weld County and Army Corps of <br />Engineers. Copies of the letters are enclosed for your records. <br />The Division will recommend approval of the acreage reduction request (AR -01) based on the inspection <br />observations.
