RECEIVED
r-'mAY 21 2012
Division of Recla oration,
May 18, 2012 Mining & Safety
✓Mr. Berhan Keffelew
Colorado Division of Reclamation Mining and Safety AGGREGATE
1313 Sherman Street, Room 215 INDUSTRIES
Denver, CO 80203
Re: Permit Number M -2004 -031— Hazeltine Mine Request for Extension,
Technical Revision 30 -Day Decision Waiver
Dear Mr. Keffelew:
On May 5, 2012 Aggregate Industries submitted a technical revision request for the
above - referenced permit in response to corrective action required by the Division
following a DRMS inspection on October 5, 2011 regarding water saturation/inundation
of a neighboring property. During a May 15 site visit with you, representatives of
neighboring land owner Orr, and AI's consultants from Tetra Tech, all parties seemed to
be in agreement to the solution proposed in the TR request, however you indicated that
the Division would need verification of approvals and/or agreements with the various
entities with whom Al is coordinating to implement the project as well as any additional
permitting requirements with other agencies before issuing approval of the request.
As discussed during the site visit, Al is actively engaged in and will continue to finalize
its coordination efforts for any necessary approvals /agreements and will work towards
addressing any other permitting requirements. Acknowledging that this will likely take
more time than the 30 -day period for the Division's decision on the TR, Al hereby
waives the 30 -day decision provision.
Very truly yours,
Connie N.
