May 9, 2012 C- 1980- 007/West Elk Mine JRS <br />ROADS — Rule 4.03 Construction 4.03.1(3)/4.03.2(3) Drainage 4.03.1(4)/4.03.2(4) Surfacing and <br />Maintenance4.03.1(5) and (6)/4.03.2(5) and (6) Reclamation 4.03.1(7)/4.03.2(7): <br />- The main mine entrance and haul road is a paved road. The road was well maintained and stable. <br />- The road to the Sylvester Gulch facilities was well maintained and stable. There was no rutting on the road and <br />no erosional problems were noted. <br />- The haul road to the RPEE was stable and well maintained at the time of the inspection. There was no rutting or <br />erosional problems noted. There was some sloughing of material off of the cut - slopes into the roadside ditch. <br />This ditch will need to be cleaned. <br />SLIDES and DAMAGE - Rule 4.12: <br />- The HR -1 slide area remained stable at the time of the inspection. There did, however, appear to be a large <br />tension crack at the top of the slope that ran the entire length parallel to the haul road. MCC does have a technical <br />revision in to the Division for the as -built for the slide repair (TR -128) but this TR was deemed incomplete, <br />pending an engineering report. <br />- The ST -02 slide area remains stable. This area was reseeded and the entire area was covered with erosion <br />control mat. <br />SUPPORT FACILITIES - Rule 4.04: <br />- During the inspection numerous active and reclaimed methane drainage wells were inspected. The active wells <br />that were inspected are E3 -51, E3 -59, 61 and 63 (on the same pad), E -47 and E -44. All of the pads were well <br />maintained and stable and no erosional problems were noted on any of these pads. There was positive drainage off <br />of all of the pads visited. All of the pads had a small topsoil stockpile above the pad and all of the topsoil <br />stockpiles had an "topsoil" sign in place. The inactive pads visited were the E1 -51 -55 pad, E1 -48 and E1 -42. The <br />reclaimed E1 -51 -55 pad had a small slump at the bottom of the reclamation. Mike Peacock indicated that there <br />have been some problems with this area and that MCC was going to get into the area once conditions allow and fix <br />the slump. Reclaimed pad E1 -48 was stable and no problems were noted. Pad E1 -42 is not reclaimed and is being <br />used as a staging area for this summer's drilling activities. <br />- All of the light -use roads constructed to access the MDW pads were well maintained and stable. There were no <br />erosional problems noted and there was no rutting on the roads. <br />- There is a flexible plastic pipe that runs along the light -use road for water for the drilling of the MDW's. Mike <br />Peacock indicated that MCC would be using water from the Dry Fork for the drilling this summer so much of this <br />pipe will probably be removed this year. <br />SIGNS AND MARKERS — Rule 4.02: <br />- The mine ID sign was in place and contained all of the necessary information. <br />- Stream buffer zone signs were in place along the Sylvester Gulch road and along the North Fork of the Gunnison <br />by the NSSA. <br />- All of the topsoil and subsoil piles inspected along the Sylvester Gulch road, the NSSA and at the MDW pads <br />had the appropriate sign in place. <br />Number of Partial Inspection this Fiscal Year: 11 <br />Number of Complete Inspections this Fiscal Year: 3 <br />Page 4 of 14 <br />
