Cat
of C0G
N o DEPARTMENT OF NATURAL RESOURCES
David H Getches,Executive Director
MINED LAND RECLAMATION DIVISION
1876 * DAVID C.SHELTON, Director
Richard D Lamm
Governor
September 6, 1984
Mr. Doug Bowman
Mid-Continent Resources, Inc.
P.O. Box 158
Carbondale, Colorado 81623
RE: Sutey Refuse Pile Technical Revision, File No. C-017-81
Dear Mr. Bowman:
Enclosed are the approval form and the publication notice for the above
referenced technical revision. This approval is for construction of the
sediment ponds, the conveyor system, the two access roads to the refuse pile
and the stream channel diversion. No other portions of the proposed refuse
pile construction plan can be started until final approval of the pending
permit revision.
Please be aware that this portion of the refuse pile construction plan is
being approved separately from the overall permit revision because the
Division believes construction of the new refuse pile is necessary to minimize
environmental impacts at Coal Basin, which is the subject of recent
enforcement actions, for the following reasons: 1 ) the remaining time left in
the construction season at Coal Basin is minimal ; 2) the current permitted
coal refuse disposal system is less desirable environmentally; and 3) the
impacts of the present disposal system would be lessened.
This technical revision is being approved with one stipulation. The
cross-sections of the access road in Disney Canyon indicate that cut and fill
slopes will be lh:lv. This is steeper than allowed by the regulations. The
typical section shows these slopes to be 1 .5 h:lv which is acceptable. Since
there is an apparent conflict, the following stipulation is necessary:
Stipulation No. 11
PRIOR TO CONSTRUCTION OF THE ACCESS ROAD IN DISNEY CANYON, THE
PERMITTEE MUST EITHER COMMIT TO CONSTRUCTION OF THE ROAD CUTS AT A
GRADIENT NO STEEPER THAN lh:lv IN ROCK AND 1 .5h:ly IN UNCONSOLIDATED
MATERIAL AND COMMIT TO CONSTRUCTION OF ROAD EMBANKMENTS AT A GRADIENT
NO STEEPER THAN 1 .5h:ly OR SUBMIT APPROPRIATE GEOTECHNICAL ANALYSES
WHICH SHOW THAT THE PROPOSED ROAD CUTS HAVE A MINIMUM SAFETY FACTOR OF
1 .5 AND THE ROAD EMBANKMENTS HAVE A MINIMUM SAFETY FACTOR OF 1 .25. IF
THE PERMITTEE COMMITS TO THE CONSTRUCTION GRADIENTS STIPULATED ABOVE,
THE CROSS-SECTIONS MUST BE CHANGED ON THE MAP.
423 Centennial Building, 1313 Sherman Street 8 Denver, Colorado 80203 Tel.
