Statement of interest in, bids on, or options on land <br /> contiguous to the permit area which are held by applicant: <br /> Although not actually contiguous to the permit area, Mid- <br /> Continent holds Federal Coal Lease No. C-074632 containing <br /> 680 acres in two parcels labeled O on the map labled <br /> Exhibit I-A-1. <br /> B. Compliance Information <br /> 1. Suspended or Revoked Mining Permits: <br /> Neither Mid-Continent Resources, Inc. , any subsidiary, <br /> affiliate, or persons controlled by or under common control <br /> with the applicant has held a State or Federal mining permit <br /> which has been revoked during the five year period prior to <br /> the date of submission of this application; or forfeited a <br /> coal mining bond or similar security deposited in lieu of <br /> bond. <br /> Mid-Continent Resources, Inc. had its Coal Basin mining <br /> permit No. C-017-81 suspended by the Colorado Mined Land <br /> Reclamation Board for one day (September 25, 1985) as <br /> punitive action for patterns of violations occuring during <br /> the period of September 22, 1983 and October 30, 1984. <br /> 2. Federal or State Violation Notices and Abatement Actions <br /> Within the Past Three Years. <br /> a. NOV C-88-021. Issued April 22, MLRD cited "Failure to <br /> maintain light use roads to ensure minimization of <br /> erosion." A berm and ditch were repaired the day of <br /> the violation. Civil penalty = $25. <br /> b. NOV C-88-022. April 22, 1988. MLRD cited "Failure to <br /> place coal refuse in a controlled manner. " Mid- <br /> Continent installed a larger ditch along the conveyor <br /> access road and submitted a plan for placing refuse in <br /> a controlled manner. Civil penalty = $525. <br /> C. NOV C-89-003 . February 22, 1989. MLRD cited "Failure <br /> to maintain sediment measures to prevent additional <br /> contributions of sediment to streamflow and to meet <br /> effluent limitations" as a result of malfunction of the <br /> pond series at outfall 016.
