(DRMS Permit No. C- 1981 -010) <br />OSM Concurrence for Phase III Partial Bond Release (SL -13) <br />Dear Mr. Berry, <br />This letter acknowledges the Office of Surface Mining (OSM), Denver Field Division's (DFD) <br />receipt and review of the above Phase III Partial Bond Release Proposed Decision document <br />prepared by the Division of Reclamation, Mining, and Safety dated March 27, 2012. The <br />inspection for this bond release was conducted on August 31, 2011. The DFD agrees with the <br />findings and decision document and hereby provides OSM concurrence for the above bond <br />release action in accordance with 30 CFR 740.15 (d) (3), and 30 CFR 906.30, Article IX, Section <br />24, of the State - Federal Cooperative Agreement. <br />DRMS's Proposed Decision documents the applicant's compliance with the Colorado approved <br />regulatory program at Rule 3.03 of the Regulations of the Colorado Mined Land Reclamation <br />Board for Coal Mining, and DRMS's bond release guidelines dated April, 18, 1995. <br />By letter dated August 25, 2011, Trapper Mining Inc. (TMI), permittee for the Trapper Mine, <br />applied for Phase III bond release for approximately 365 acres of lands in the Ashmore (A), <br />Derringer (D), and Flintlock (F) Pits. The lands included in this SL -13 bond release request <br />received Phase I and II bond release with DRMS approval of SL -5 and SL -6. These areas were <br />sampled during 2010 and 2011 by Kent Crofts of IME to determine vegetation establishment <br />success for Phase III bond release. <br />This Phase III bond release applies to 323.5 acres for parcels A -B -00, A -B -01, A -B -99, D -AB- <br />00, D- AB -99, D -C -99, F- AB -00, and F- AB -99. This acreage differs from the original amount <br />requested for bond release as a result of an adequacy review letter that was sent to TMI on <br />January 18, 2012. In that letter, DRMS cited that a portion of F -AB -01 (included in the phase III <br />bond release request) was seeded in the spring of 2002 and therefore not eligible to receive phase <br />III bond release. TMI also requested that a parcel of land for a corridor to the Oak Gulch <br />
