Pineda <br />Director <br />The Division of Reclamation, Mining and Safety (DRMS) has received your request to <br />participate as a cooperating agency in the preparation of Environmental Impact Statements for <br />the West Elk Mine coal lease modification(s). The DRMS agrees to participate to the extent that <br />time allows. We assume that a Memorandum of Understanding will be drafted to define our <br />interaction. To that end, please preface any language in the Memorandum of Understanding to <br />indicate that DRMS will participate "to the extent reasonable and as resources allow." Before <br />signing the MOU, I request that DRMS have the opportunity to review a draft copy with the <br />details included for the West Elk Mine lease modification(s). <br />We look forward to working with the USFS on the review of the EIS.
