OBSERVATIONS <br />PERMIT #: M- 1992 -108 <br />INSPECTOR'S INITIALS: MAC <br />INSPECTION DATE: April 25, 2012 <br />The inspection was conducted by Michael Cunningham of the Division of Reclamation, Mining and Safety <br />(Division). Abe Vasquez and Raul Vasquez were also present for the inspection. The Bad Boy Stone site is <br />located approximately 8 miles northwest of Lyons, Colorado. The site is permitted for 6.5 acres and the post - <br />mining land use is residential. <br />The permit sign was posted at the site entrance and the boundary of the affected area was clearly delineated <br />as required by Rule 3.1.12. The site was not actively being mined at the time of the inspection. According to <br />the Operator, mining at this quarry is complete and final reclamation will commence this year. <br />The quarry is situated on the east side of a ridge which runs north and south. The site has been largely leveled <br />off to make way for a future residential site. There are several benches along the west side of the site, which <br />are approximately 2 - 4 ft. in height and 3 ft. wide; volunteer trees and shrubs have begun to establish on the <br />benches. The western edge of the site contains large blocks of sandstone which will need to be removed from <br />the site or placed into the pit prior to release. The Division observed an overburden stockpile on the east side <br />of the site; this material will be placed into the pit. The Operator should salvage all topsoil and fines from the <br />overburden stockpile, to spread over the reclaimed pit. The pit is located at the southeast corner of the site <br />and is approximately 0.15 acres in size. <br />The following reclamation tasks remain to be completed: <br />1) Backfill pit with overburden stockpile and excess product material <br />2) Grade backfilled area to 3H:1V or less <br />3) Replace topsoil over disturbed areas <br />4) Seed disturbed areas <br />Once the above reclamation tasks have been completed, including the establishment of vegetation, the <br />Operator may request a full performance and financial warranty release in accordance with Rule 4.17. The <br />written notice requesting release shall include the names and addresses and phone numbers of all owners of <br />record of affected land, shall be sent by Certified Mail, and shall contain a signed statement by the Operator <br />that all applicable portions of the Reclamation Plan requirements have been satisfied. <br />The Division holds a financial warranty in the amount of $5,300, which has been determined to be sufficient to <br />complete reclamation. <br />This concluded the inspection. <br />Page 2 of 3 <br />
