As to the insufficiency of the financial warranty we are currently exploring our <br />options in increasing the amount and distributing proof of the increase to the proper agencies. Next I <br />would like to address your concerns in regard to the berm along the river inside the boundary of our <br />current 110c permit. You stated "The Operator was informed that this type of bank stabilization activity <br />within the permit area was not authorized by the Division at this time." If you had in fact studied our <br />approved application you would have found and engineered and approved structure in which we have <br />diligently constructed and are continuing to do so to those exact specifications so that we remained in <br />compliance with respect to the mining plan. You also stated "The Division is aware that the operator <br />has not disturbed this buffer area, but is concerned that continued erosion of this bank will create <br />potential for significant sedimentation to the river and possible pit capture." This does seem like a <br />contradiction. You would like us to prevent capture of the pit by erosion caused by the river; however, <br />you would not like us to do anything about it. This would seem like it would be hard to stay in <br />compliance with the Mining permit with either action. I would also like to address your concerns with a <br />berm that is outside the permitted area on family owned private property. Both I and our organization <br />are deeply concerned that you chose to use division resources to propagate unjustified and unverified <br />claims that a private structure on private property was somehow violating some sort federal regulations. <br />I would just like you know that we will be contacting your superiors, our State Representative, and the <br />Governor's Office to determine if your time devoted to matters outside of your intended purpose of our <br />visit was justifiable. We also would like to make sure that we have your complete personal information <br />including your legal name and address to give to our attorney in the event that this matter does indeed <br />require further investigation and you can be held personally liable.
