Discharge of Water into an Underground Mine

This section does not apply to the proposed New Horizon North Mine, a surface
operation.

J. Stream Buffer Zones

WFC will maintain a 100 foot buffer zone along Nygren, Meehan, and Glasier
Draws within the permit area (4.05.18(1)).

K. Probable Hydrologic Consequences (Groundwater)

The operator’s discussion of the Probable Hydrologic Consequences (PHC) is
presented in Section 2.05.6(3) Protection of Hydrological Balance of the permit
application. Concerning groundwater WFC presents their assessment that the
probable impacts to groundwater were determined to have no short or long term
significance, or a plan has been presented to mitigate those impacts determined to
have significance. WFC provides a summary of the probable hydrologic
consequences in Appendix 2.05.6(3)-2. With regard to groundwater, WFC provided
a PHC analysis for the shallow unconfined bedrock groundwater. Deeper bedrock
groundwater under confined conditions will not be affected by the mining
operations. Alluvial groundwater is essentially non-existent within the permit and
immediate adjacent areas. WFC identified five potential groundwater impacts that
may result from NHN Mine operations. These are summarized below along with
their significance.

1) Interruption of groundwater flow and drawdown. The bedrock zones,
overburden and coal, will be exposed or daylighted by the NHN excavation.

26
