The DRMS' letter dated April 16, 2012 transmitted its incomplete letter for the referenced
technical revision. On behalf of New Elk Coal Company (NECC) following are its responses to
the DRMS' comments and concerns.
1. DRMS - Please provide a description of the proposed return of coal mine waste to
abandoned workings required by the following Rules: 2.05.3 (9)(a -e) and 4.11.3.
NECC - See amended page 2.05 -44b for the required discussion.
2. Please provide a letter from the legal or equitable landowner that would initiate,
implement, approve, or authorize the use of the land following reclamation as required by
Rule 2.05.5(2)(b).
NECC - See attached letter from the landowner who is NECC. The County considers the
site to be grandfathered so it does not exercise any authority over the land use
classifications. The County is going to require NECC to obtain a special use permit for
the PR -04 permit expansion.
3. Please provide an updated Map 15 including the area of the proposed construction of the
29 -foot diameter ventilation shaft required by the following Rule: 2.05.5(2)(c).
NECC - An updated Map 15 is enclosed.
4. Please provide the design and calculations for the upland diversion ditches above the
proposed construction of the 29 -foot diameter ventilation shaft to fulfill the requirements
needed by the following Rules: 4.05.3(2 -3) and 4.05.3(7)(a -c)
