Zach Trujillo -3- May 4, 2012 <br />2. DRMS: Please address the need for additional water monitoring to ensure that the <br />hydrologic balance is being protected (Rule 4.05.13). The Division believes the following <br />monitoring would be beneficial: monitoring well in the alluvium between the DWDA and <br />the river, a surface monitoring point at ditch D31, and a surface water monitoring point <br />at culvert C27. Please include this monitoring plan in your submittal or justify <br />why this additional monitoring is not needed. <br />NECC: NECC does not believe a surface monitoring point at Ditch D31 or C27 is <br />necessary for compliance with Rule 4.05.13. <br />Ditch D31 would be the outlet of Containment Area No. 2. However, there is no <br />permitted outfall at Ditch D31, and, Containment Area No. 2 is designed to contain the <br />25 -year event, per Rule 4.05.9(2)(e). As discussed on page EXH.19(22) -1, water <br />collected in Containment Area No. 2 will be hauled back to Pond 007 for discharge. Rule <br />4.05.13(2)(a)(i) states monitoring shall "be adequate to measure accurately and record <br />water quantity and quality of the discharges from the permit area ". There will be no <br />discharge to D31 from Containment Area No. 2. <br />Culvert C27 is not hydraulically connected to runoff from the disturbed area associated <br />with TR -65. Culvert C27 accepts clean water runoff, as defined by Rule 4.05.2(4), from <br />D29 and Culvert 54. Runoff from the soil storage area and the sediment drying area will <br />be contained in Containment Area No.1, and therefore not connected to the clean water <br />flowing through C27. There is no precedent for monitoring clean water on -site. <br />During the on -site inspection May 1st, attended by NECC and DRMS, monitoring at C27 <br />was discussed. It is understood by NECC that DRMS will not require monitoring at C27. <br />In order to comply with Rule 4.05.13, NECC agrees to install an alluvial well between the <br />West DWDA and the Purgatoire River and agrees to begin monitoring an upstream point <br />on the Purgatoire River. <br />Please feel free to contact me if you have any questions. <br />Sincerely, <br />Tamme Bishop, P.E. <br />Project Engineer <br />cc: Ron Thompson, NECC <br />Mike Trujillo, CDOW <br />
