Scott, Environmental Protection Specialist
CC: Division 1 Office, District 3 Water Commissioner
FROM: Sarah Brucker, P.E.{;
RE: Boettcher Limestone Quarry No. M -1977 -348
Operator: Holcim (US) Inc.
Contact: (719) 784 -1402
Sec. 31, Twp. 9 North, Rng. 69 West, 6th P.M., Larimer County
COMMENTS: The applicant has requested a partial acreage release for the Boettcher Limestone Quarry. The
release is for approximately 580 acres, consisting of an 80.4 acre area in the southern portion of the property
and a 480.4 acre parcel to the north.
A field inspection by DRMS staff on June 19, 2009 found that water has collected in the bottoms of several of
the reclaimed quarry areas. The inspection report required Holcim to contact the State Engineer's office to
determine what options are available to deal with the water retained in these areas, and provide DRMS with the
appropriate documentation of the resolution of this issue before the site can be released. This office has no
record of any contact from Holcim regarding the Boettcher Limestone Quarry.
A site inspection conducted by the District 3 water commissioner on May 18, 2010 found that Pit 2, located in
the NW' /4 of Section 8, Township 8 North, Range 69 West of the 6th P.M., within the area requested to be
released, appeared to expose ground water to the atmosphere. A letter was sent to Mr. Gordon Benton dated
July 15, 2010, identifying the issue and potential solutions, and requesting a written response by September 30,
2010. No such response can be found in the files of this office. A copy of the July 15, 2010 letter is attached.
Holcim must contact the State Engineer's office to identify the source of water retained in the reclaimed areas
and to ensure compliance with Colorado water law before the requested acreage is released.
r
''MAY 01 2012
Division of Reclamz'
Mining & Saf+:.:
Office of the State Engineer
1313 Sherman Street, Suite 818 • Denver, CO 80203 • Phone: 303 - 866 -3581 • Fax: 303 - 866 -3589
www.water.state.co.us
