Section 2.03 <br />Legal, Financial, Compliance and Related Information <br />Western Fuels Colorado, A Limited Liability Company (WFC) is applying to secure a mining <br />permit from Colorado Division of Reclamation, Mining and Safety (DBMS) for New Horizon <br />North (NHN) Mine in Nucla, Colorado. This mine is adjacent to the previous Nucla Mine <br />operated by Peabody Coal Company (PCC) and later sold to WFC. <br />PCC submitted an application for the Nucla Mine in April 1981, and in May 1983, Permit No. C- <br />008-81 was issued by the Colorado Mined Land Reclamation Division. The geographically <br />separate Nucla East Mine was incorporated into the permit in 1989. In 1992, the mining permit <br />(C- 1981 -008) was transferred to Western Fuels - Colorado (WFC), and the two permit areas were <br />renamed the New Horizon 1 (NHI) and New Horizon 2 (NH2) Mines. All raining at NH l <br />(formerly the Nucla Mine) was completed by PCC, while mining at NH2 (formerly Nucla East) <br />has been conducted solely by WFC. The remaining 103.42 acres of the NH1 Mine, also known as <br />the Rice tract, is being incorporated into the NHN Mine permit (C- 2010 -089) and will be <br />subsequently released from the New Horizon Mine permit (C -1981 -008). Map 2.04.3 -2 in Section <br />2.04.3 delineates areas previously mined, including "pre -law" disturbance, NH and NH2 permit <br />area boundaries and areas of previous coal extraction within these permit boundaries. NH 1 Mine <br />will cease to exist after the approval of NHN Mine permit by DBMS. <br />The statements below are intended to address the requirements of Section 2.03 of the regulations <br />of the State of Colorado Mined Land Reclamation Board. <br />2.03.4(1) The applicant is a Colorado limited Liability Company <br />2.03.4(2)(a) Identification of Permit Applicant <br />David G.
