DISTRICT COURT, PITKIN COUNTY, COLORADO
Case No. 97CV 13 1-1
UNOPPOSED MOTION AND ORDER FOR EXTENSION OF TIME
BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO and
THOMAS CARL OKEN, PITKIN COUNTY TREASURER,
Plaintiffs and Third-Party Defendants,
V.
MID-CONTINENT RESOURCES, INC., and LOUIS M. LAGIGLIA, CREDITORS'
TRUSTEE UNDER BANKRUPTCY PLAN OF LIQUIDATION,
Defendants and Third-Party Plaintiffs, and
MIDCON REALTY, LCC, Third-Party Plaintiff,
V.
STATE OF COLORADO, DEPARTMENT OF NATURAL RESOURCES, DIVISION OF
MINERALS AND GEOLOGY and BOARD OF COUNTY COMMISSIONERS OF
PITKIN COUNTY AND THOMAS CARL OKEN, PITKN COUNTY TREASURER,
Third-Party Defendants.
Third-Party Defendant, Division of Minerals and Geology ("Division"), moves for an
extension of time within which to respond to Mid-Continent Resources and Louis LaGiglia's
Motion to Strike, to and including February 10, 1999, for the following reasons:
1. The Motion to Strike concerns certain defenses that Pitkin County and the
Treasurer have raised to the Amended Third-Party Complaint. The Motion involves the
reclamation authority of the Division including whether the Division's authority preempts the
County's involvement in reclamation issues.
