The parties note that MidCon Realty, LLC, has filed a motion to intervene as a Third- <br /> Party Plaintiff in this case. If allowed to intervene, the LLC will be represented by the Third- <br /> Party Plaintiffs' undersigned counsel and will abide by the deadlines set forth herein. <br /> II. <br /> DISCLOSURE <br /> A. Rule 26(a)(1) Disclosure <br /> l. Defendants and Third-Party Plaintiffs, Mid-Continent Resources, Inc. <br /> And Louis M. LaGiglia, Creditors' Trustee under Bankruptcy Plan of Liquidation <br /> (collectively hereinafter "MCR"), served their initial disclosure certificate pursuant to <br /> Rule 26(a)(1), COLO. R. CIV. P., October 7, 1997. It disclosed prospective witnesses <br /> and persons who may have discoverable information, and it enumerated anticipated <br /> exhibits and made them available for inspection and/or copying at MCR counsel's office. <br /> A copy of MCR's disclosure statement is attached as Exhibit-A to this Order. <br /> 2. Third-party Defendant, State of Colorado, Department of Natural <br /> Resources, Division of Minerals and Geology ("DMG") served its initial disclosure <br /> statement pursuant to Rule 26(a)(1) on October 7, 1997. It disclosed persons who may <br /> have discoverable information, enumerated potential exhibits which are available at <br /> DMG's Denver and/or Grand Junction office. A copy of DMG's disclosure statement is <br /> attached as Exhibit-B to this Order. <br /> 3. Plaintiffs and Third-Party Defendant, Board of County Commissioners of <br /> Pitkin County, Colorado and Thomas Carl Oken, Pitkin County Treasurer, (hereinafter <br /> "Pitkin County") served their initial disclosure certificiate pursuant to Rule 26(a)(1) on <br /> October 8, 1997, disclosing persons who may have discoverable information, and making <br /> documents and tangible things, as practicable, available at the office of counsel for Pitkin <br /> County. A copy of Pitkin County's disclosure statement is attached as Exhibit-C to this <br /> Order. <br /> B.
