DEFINITIONS
<br /> As used herein, the following terms mean:
<br /> 1. The words "you," "your" or "DMG" mean Third-Parry Defendant Division of
<br /> Minerals and Geology, its present and former agents and employees and all other persons actin
<br /> or purporting to act on its behalf or on behalf of its predecessors.
<br /> 2. "MCR" shall mean both Third-Parry Plaintiffs, Mid-Continent Resources, Inc.,
<br /> and Louis M. LaGiglia Creditors' Trustee under Bankruptcy Plan of Liquidation.
<br /> 3. The word "document" means all written, printed, typed, recorded or graphic
<br /> matter, facsimile transmissions, photographic matter (including prints, slides and negatives),
<br /> sound reproductions, computer files, computer hard drives, computer discs and hard copy
<br /> printouts, tapes, in-puts or out-puts, however produced or reproduced, or any other matter from
<br /> which information may be obtained whether draft or final, original or reproduction, including, but
<br /> not limited to, letters, correspondence, memoranda, minutes, notes, films, videotapes, audiotapes,
<br /> recordings of any kind, transcripts, contracts, diaries, desk calendars, telegrams, telexes, wires,
<br /> faxes, reports, interoffice or intraoffice communications, including electronic mail, whether
<br /> deleted, saved or stored, data stored and any computer media, computer runs or printouts,
<br /> spreadsheets, tabulations or materials similar to any of the foregoing, however denominated, and
<br /> by whomever prepared and to whomever addressed and non-identical copies thereof, all non-
<br /> identical copies referred to or reproductions however made of the original document which have
<br /> notations, markings, comments or other material not appearing in the original.
<br /> 4. The word "concerning" includes referring to, alluding to, responding to, relating
<br /> to, connected with, commenting on, in respect of, about, regarding, discussing, showing,
<br /> addressing, describing, mentioning, reflecting, analyzing, constituting, pertaining to or
<br /> evidencing.
<br /> 5. The word "communication" means any contact between two or more persons,
<br /> agencies or companies and shall include without limitation written contact by such means as
<br /> letters, electronics, mail, memoranda, telegrams, telexes, facsimile transmissions or by any
<br /> document and oral contact by such means as face-to-face meetings and telephone conversations.
<br /> 6. The word "person(s)" means all entities and agencies and includes without limiting
<br /> the generality of the foregoing, natural persons, joint owners, associations, companies, partners,
<br /> joint ventures, corporations, trusts, and estates, governmental agencies or subdivisions.
<br /> 7. The word "identify," with respect to a document, means list the document type
<br /> (letter, memorandum, notes, etc.), date, title, author, recipient and summary of subject matter.
