Mr. Delaney's letter suggests that Mid - Continent and
the Forest Service pursue an exchange of the remaining Coal Basin private property which would
leave the entire Coal Basin mining site within ownership of the United States Forest Service. I
believe this is a result that can benefit all parties to the litigation, as well as the Forest Service
itself and the general public interest. Therefore, I think we should strongly consider working
toward a settlement that will include such a land exchange.
In order to facilitate a settlement along these lines, I believe that it is important to include
the Forest Service in our mediation that we are planning to schedule for late April, assuming of
course the Forest Service agrees to attend. Another potential attendee for the mediation is Adam
Poe. Mr. Poe was closely involved in the other land exchanges in Coal Basin and is adept in
working through the Forest Service bureaucracy in bringing such land exchanges to fuition
