i <br /> Preparation Guide <br /> Page 2 <br /> IL ATTORNEYPARTICIPATION <br /> We encourage attorneys to fully participate in the mediation process. However, it is sometimes better if the <br /> client tells part or all of their story and explains, in their own words, what they want or need from this <br /> dispute. <br /> III. ROLE OFATTORNEY <br /> Your role in mediation is different from the Pole you play in litigation. Please consider the following when <br /> evaluating your role: <br /> A.) Preparing your Client <br /> When preparing your client for mediation,please consider the following: <br /> •Help your client prepare a list of all issues to be resolved <br /> •Help identify the needs and interest of your client in relation to the issues <br /> •Help your client to recognize the needs and interest of the other party <br /> •Discuss with your client what they really need, not want, out of the lawsuit <br /> •Help your client decide what is their best position if they do not make an agreement with the other <br /> party. <br /> B.) Attending the Mediation Session <br /> At the mediation session,you should be prepared to present the case in a summary fashion,to assist <br /> your client in identifying and assessing options, and to assist your client in deciding which options are <br /> in their best interest. <br /> C.) Developing and Finalizing an Agreement <br /> A major objective of mediation is to develop an agreement that embodies the best solution for all <br /> parties. Your participation can be valuable in constructing an agreement that is workable for all <br /> parties. <br /> IV CLIENT'S ROLE <br /> Your client's role is to be honest and give complete disclosure of all the information relevant to the dispute. <br /> Your client is also expected to make a good faith effort to explore all possibilities for a resolution to the <br /> dispute. This good faith effort includes a recognition that your client may need to compromise some <br /> positions in response to concessions from the other party. <br /> V. FEES <br /> Our mediation fees are shown in the attached Fee Schedule. Payment of all fees is the responsibility of the <br /> attorneys. <br /> Our office strives to assist litigants in solving their disputes in a manner that is in the best interest of all parties. <br /> We appreciate the opportunity to work with you and your client on this matter. <br />
