PKA -9 -424 <br />Coal Basin/Dutch Creek Diversion <br />Bear Creek Project <br />INTERROGATORY NO. 5: Identify and describe any communication, written or oral, <br />you have had with the United States Forest Service in which proposed or performed reclamation <br />activities at Coal Basin mine site were discussed. Include in your response the extent of the <br />discussion about reclamation, the date of the communication, and a detailed summary of its <br />contents. <br />ANSWER NO. 5: Objection, burdensome. The written and oral communications <br />requested in this interrogatory are extremely numerous, have occurred over many years and are <br />too voluminous to completely itemize. MCR is in the process of gathering copies of all written <br />correspondence with the Forest Service and will make those documents available upon <br />reasonable notice. Many of the oral communications occurred during public hearings and site <br />visits arranged by DMG at which Forest Service representatives were present, as well as MCR <br />representatives. <br />INTERROGATORY NO. 6: Identify all documents upon which you referred or relied <br />in responding to the above Interrogatory no. 5. <br />ANSWER NO. 6: See response to Interrogatory No. 5, above. <br />INTERROGATORY NO. 7: Identify and describe any knowledge you had of <br />communications between the Division and the United States Forest Service from July 1994 to <br />present regarding any and all reclamation activities proposed to be performed at Coal Basin by <br />the Division, including but not limited to, discussions about steep slope revegetation. Include in <br />your response the time and the specific details of your knowledge and the nature of the <br />communication. <br />ANSWER NO. 7: Robert Delaney, Diane Delaney and Greg Lewicki attended a <br />meeting with DMG and USFS representatives on October 6, 1994. The USFS made no demand <br />for steep slope reclamation. <br />INTERROGATORY NO. 8: Identify all documents upon which you referred or relied <br />in responding to the above Interrogatory no. 7. <br />ANSWER NO. 8: See response to Interrogatory No. 7, above. <br />6 <br />
