DMG sent CDPBE a letter, dated May 3, 1999, requesting <br /> CDPHE's advice as to whether the plan proposed by DMG in the letter would be acceptable <br /> to CDPHE. CDPHE responded in a letter dated May 6, 1999, that DMG's plan would be <br /> acceptable to CDPHE. Based on CDPHE's response, DMG agrees to apply for stormwater <br /> pen-nit(s)under the terms set forth in DMG's May 3, 1999, letter. DMG's letter and <br /> CDPHE's response letter are attached as Exhibits B and C, respectively, and are incorporated <br /> into this agreement. MidCon agrees not to in any way object to DMG's plan or <br /> attempt to prevent performance of DMG's reclamation on its property." <br /> Paragraph 15,I suggest we specify which party will record the agreement. <br /> Perhaps this is something Debbie Quinn can do since she is located in Pitkin County. <br /> Paragraph 16, third litre, after"MidCon completes" add"to the satisfaction of <br /> DMG." As to fill in the blank, add"Complete filling of the slot bin depression until ground <br /> level;reshape the hillside below the old scale house adjacent to the railroad tracks until <br /> stable; remove the remaining metallic scrap materials located throughout the site, including <br /> the underground mining equipment, beltline supports and miscellaneous materials; and <br /> remove miscellaneous non-metallic trash and debris scattered throughout the site."
