Page 5
CDPHE, it appears that outfall 025 may have mine water discharge. 'Therefore, this outfall
will also be excluded from the Division's permit application. I will fax you an updated list of
the outfalls to be included in the Division's stormwater permit application..
PRO-2. under AGRIEEMF,N'T
Concerning paragraph 17, in arty May 12 letter I listed the work to be done at the Coal
LoadOut. However, you did not include all of the work I listed in my letter in the draft
agreement. Your draft leaves out removal of the remaining metallic scrap materials located
throughout the site, including the underground mining equipment, beltline supports and
miscellaneous materials. Was this an oversight or do you have an objection to removal of
these items?
Lastly, have you gotten further information about whether the Division needs to be a
party to the escrow agreement? As I mentioned to you, I do not believe the Division should
be a party to that agreement.
Sincerely,
C4 P
CHER'YL .LINDEN
First Assistant Attorney General
Natural Resources and Environment Section
(303) 866-5127
(303) 866-3559(FAX)
cc: Mike Long
Steve Renner
AG ALPHA: NRCLICABY
AG MILE: DOCUMZMr2.SET.LT2
90 'd 22:8 66, K fipW 8Sa998i0i:Xpd
