If retained, DMG has suggested removal of the <br /> outlet pipes, and installation of rocked spillways. To the extent the reclamation process <br /> converts these ponds into permanent water features or wetlands, they should not be <br /> included in any CDPS permit. Mid-Continent requests that, on removal of the spillway <br /> pipes and installation of the proposed rock spillways, each site be discontinued as an <br /> outfall. <br /> Mid-Continent further requests modification of the permit to reflect the fact that <br /> there is no coal preparation plant in existence or discharging at the site. The <br /> preparation plant facility has been dismantled and removed, and the foundations taken <br /> up and buried. Mid-Continent believes there is no further need to permit, or pay fees <br /> for, discharges from a preparation plant that has ceased to exist. <br /> We appreciate your consideration of these matters and request to meet with you <br /> in the near future, preferably during November, for discussion of these any other issues <br /> which may be of concern.
