Schmid <br />4803 Prairie Ridge Drive <br />Fort Collins, CO 80526 <br />STATE OF COLORADO <br />RE: Kula Gravel Pit; DRMS File No. M- 1985 -200; Follow -up on Unresolved Problems <br />Dear Mr. Erker and Ms. Schmid, <br />The above - mentioned site has had one or more problems noted that, according to Division of <br />Reclamation, Mining and Safety (Division) records have not yet been resolved. According to our records, <br />the following problem was to be resolved on or before March 30, 2012. Listed below are descriptions <br />and corrective actions for the problem. Please resolve the corrective actions and provide evidence of <br />such resolution on or before May 31, 2012. <br />Please note that if the corrective action(s) are not properly addressed, and evidence provided to the <br />Division by the date provided above, the listed problems could be escalated to the level of possible <br />violations and would then be referred to the Mined Land Reclamation Board for further action. <br />Problem Description: <br />• The site has been inactive for more than 180 days. Rule 1.13.5 states, if an Operator temporarily <br />ceases production of the mining operation for one hundred eighty (180) days or more, the Operator <br />must file a Notice of Temporary Cessation in writing to the Office. <br />Corrective Action: <br />• The Operator shall file a Notice of Temporary Cessation along with the filing fee of $144 by the <br />corrective action date. <br />If the problem has already been remedied, please provide evidence of its completion.
