Drawer 790
Glenwood Springs, CO 81602
RE: Credits taken against reclamation funds under MCR's liquidation plan
Dear Ed:
As we have previously discussed, the Division has questions concerning the credits
Mr. LaGiglia is taking against the reclamation funds under MCR's liquidation plan. The
specific amounts are those listed in the Trustee's report to the Creditors' Representatives as
"Expenses incurred prior to Plan Effective Date" ($302,475.21) and"Expenses Incurred"
($80,029.78).
I periodically review the Trustee's reports and the accompanying documents.
However, I cannot determine from these reports or documents what goods or services were
bought or rendered with these amounts of money. You have suggested that I meet with
Diane Delaney about this matter since Mr. LaGiglia became Trustee after these amounts
were incurred. Do you have a telephone number where I can contact Diane? Do you want
to attend my meeting with her (and perhaps with Louis LaGiglia and Greg Lewicki)?
Also, the response to the Division's discovery request mentions that an accounting on
reclamation matters with general ledger sheets attached was provided to DMG on September
18, 1996. I am uncertain to which accounting you are referring. I would like to review a
copy of the accounting and ledger sheets prior to meeting with Diane Delaney. Will you
provide such a copy?
I am hopeful that once I see the documents and meet with Diane Delaney (and
perhaps with Greg Lewicki and Louis LaGiglia) that the Division's concerns will be
resolved.
