In the Recitals, the Settlement Stipulation states under paragraph b that the
Defendants' Third-Party Complaint "seeks an accounting for permit reclamation work done
on behalf of DMG, a recognition of permit reclamation and remedial work performed by
[Mid-Continent Resources] and its PLAN liquidator, and the DMG's remaining permit
required reclamation work." Settlement Stipulation, page 2, Recitals paragraph b.
2. The Division objects to this language because the Defendants' Third-Party
Complaint does not request an accounting for reclamation work done on behalf of the
Division or for a recognition of work done by Mid-Continent Resources or the"PLAN
Liquidator."
