DISTRICT COURT, COUNTY OF PITKIN, STATE OF COLORADO
CASE. NO. 97 CV 131-3
BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO, AND
THOMAS CARL OKEN, PITKIN COUNTY TREASURER,
PLAINTIFFS,
V.
MID-CONTINENT RESOURCES, INC., AND LOUIS LAGIGLIA, CREDITORS' TRUSTEE
LiNDER BANKRUPTCY PLANT OF LIQUIDATI0N,
DEFENDANTS AND THIRD-PARTY PLAINTIFFS,
V.
STATE OF COLORADO, DEPARTMENT OF NATURAL RESOURCES, DIVISION OF
MINERALS AND GEOLOGY,
THIRD-PARTY DEFENDANT.
THIRD-PARTY DEFENDANT RESPONSE TO MOTION TO APPROVE
SETTLEMENT STIPULATION BETWEEN PLAINTIFFS AND DEFENDANTS
The Third-Party Defendant, State of Colorado, Department of Natural Resources,
Division of Minerals and Geology ("Division" or"DMG"), by and through the Office of the
Colorado Attorney General, responds to the Motion to Approve Settlement Stipulation Between
Plaintiffs and Defendants as follows:
1. In the Recitals, the Settlement Stipulation states under paragraph b that the
Defendants' Third-Party Complaint "seeks an accounting for permit reclamation work done
on behalf of DMG, a recognition of permit reclamation and remedial work performed by
[Mid-Continent Resources] and its PLAN liquidator, and the DMG's remaining permit
required reclamation work." Settlement Stipulation, page 2, Recitals paragraph b.
2. The Division objects to this language because the Defendants' Third-Party
Complaint does not request an accounting for reclamation work done on behalf of the
Division or for a recognition of work done by Mid-Continent Resources or the"PLAN
Liquidator."
