Part 1. Roads A,B,C,D, The road extending from the Coal Preparation Plant Site
Huntsman (± 405 Ac.) westerly to and beyond the Rock Tunnels
Lamphouse and to the saddle easterly of the Dutch
Creek No. 1 and Dutch Creek No. 2 Mines portals
should not be changed as it will be needed for post-
mining uses.
Part 2. Pond Removal The permit (Task #10) contains an item for sediment
pond removal;however,it is our understanding that the
Forest Service wants these ponds to remain as a
sediment control measure and small areas of wetlands;
for these reasons the sediment ponds should not be
removed because of appropriate post-mining uses.
Part 3. Rock Tunnel The Rock Tunnels Lamphouse, the power line to the
Vicinity Lamphouse, and the road serving the Lamphouse are
required for post-mining uses; the Lamphouse area has
been the subject of extensive reclamation work; no
further reclamation work, other than possible
revegetation,is required.
Part 4. Facilities Area If this is intended to refer permit bond Task #8,
additional work is required as stated in the Lewicki
Report.
Part 5. Facilities Area We assume this refers to permit bond Task #8; addi-
Demolition tional work is required as stated in the Lewicki Report.
Part 6. Mine Bench We assume this refers in part to permit bond
Outslope Task #1; additional work is required as stated in the
Revegetation Lewicki Report excluding, however, areas of "pre-lacy"
disturbance.
Part 7. Mine Maintenance This category was not included in either the permit
bond nor the 1991 mid-term review and is improper.
Part 8. Seed Bid Seed is required as part of the site revegetation (Task
#1) for the areas and according to the permit bond and
mid-term review determinations.
Part 9. Soil Analysis Some soils analysis is appropriate as part of the
revegetation process(Task#1);whether additional soils
analysis is necessary is not known.
MCR RESPONSES TO
CrvrL No.97 cv 131-3 -8- DMG INITIAL DISCOVERY
