Part 5. <br /> (a) The prices paid for the real property parcels sold are set forth in <br /> Defendants' response to Interrogatory No. 13. <br /> (b) The prices paid for personal property are contained in the monthly <br /> reports provided the Creditors'Trustee by M&F/King.These are identified as MCR Exhibits <br /> Nos.45 through 107 in Defendants' Rule 26(a)(1)Disclosures, dated and mailed to counsel <br /> for DMG October 7, 1997. These documents have been previously identified in said <br /> disclosures. <br /> Part 6. Most ad valorem taxes were paid from sale proceeds as sales <br /> involving the assessed properties were closed. Some ad valorem taxes due Pitkin County <br /> were disputed.The disputes have now been mostly and settled.These as well as the three <br /> unresolved so-called"reserved issues" are fully described in Settlement Stipulation between <br /> Pitkin County and MCR, dated January 28, 1998, filed with this Court and served upon <br /> counsel for DMG that is the subject matter of MCR's "Motion to Approved Settlement <br /> Stipulation Between Plaintiffs and Defendants," dated January 29, 1998, and the Court's <br /> Order approving the same entered February 23, 1998. <br /> Interrogatory No. 25. Identify any and all personal or real property subject to <br /> MCR's liquidation plan which has not been sold,or which is subject to pending sale,and <br /> the estimated value of the property. Identify the method or basis used to assert the <br /> estimated value or appraisal of the property, e.g.,book value,market value, etc. <br /> Response to Interrogatory No.25. Virtually all personal property except that <br /> equipment stored in the Carbondale Rail Loadout storage bin owned by MCR has been <br /> sold. <br /> All real property, other than <br /> (1) Preparation Plant Site:Approximately 350 acres of the original 405 <br /> acres of the so-called Preparation Plant Site, <br /> (2) Coke Oven Tract:Approximately 14 acres comprising the so-called <br /> "Coke Oven Tract" adjacent to the Village of Redstone, and <br /> (3) Carbondale Loadout Site:The approximate 90 acre remainder of the <br /> so-called Carbondale Loadout site, <br /> has been sold or is under contract.The so-called"Winter Park" sale,approximately 83 acres <br /> of the Preparation Plant Site,is under contract but has not as of this date closed. <br /> MCR RESPONSES TO <br /> CIVIL No.97 cv 131-3 -21- DMG INITIAL DISCOVERY <br />
