negotiate a resolution of the pending issues and to perform reclamation of the site, rather than
to litigate these issues. Litigation of these matters would be lengthy and costly to the parties
and to the Court.
5. Accordingly, the parties respectfully request that this Court vacate the schedule set
forth in the Second Interim Case Handling Order, and to stay further proceedings pending
negotiations between the parties. The parties are hopeful that discussions will lead to
resolution of all issues pending in this case or at the very least, will lead to resolution of some
of the issues. Such request will therefore save this Court's time and resources, and will allow
the parties to use their resources toward the accomplishment of reclamation.
6. The parties will file monthly status reports concerning the progress of their
negotiations. The parties anticipate that negotiation may take months given the technical
nature of the issues and the fact that negotiations will likely entail discussions with third
parties such as the United States Forest Service.
WHEREFORE, the Third-Party Piaintiffs and the Third-Party Defendant res-ectfuiiv
request that this Court vacate the schcdh pie set forth in the Sccond Interim `:aEe Handling
Order and stay further proceedings pending negotiations between the parties.
GALE A. NORTON
Attorney General
MARTHA PHILLIPS ALLBRIGHT
Chief Deputy Attorney General
3
