Plaintiffs filed their complaint against the Division in July 1997. The relief requested in the <br /> complaint is primarily for an accounting which sets forth, among other things, what money <br /> the Division has spent on reclamation and what the Division estimates it still needs to <br /> complete reclamation. Specifically, the Third-Party Complaint's request for relief is as <br /> follows: <br /> ... that this Court order DMG account for Creditors' <br /> Trust funds received, paid-out, on-hand, and anticipated to be <br /> paid out and order DMG's full and complete compliance with <br /> the PLAN; this Court should also determine the balance of <br /> Creditors'Trust funds, if any, owing DMG to be paid before ad <br /> valorem taxes and other expenditures as detailed in Defendants' <br /> amended third counterclaim (Declaratory Relief; PLAN <br /> Disbursement) ..., and grant such other and further relief as to <br /> the Court appears proper. <br /> The Division agreed to give the Third-Party Plaintiffs the accounting they request in <br /> their complaint. The Division gave them the accounting in January 1998. This accounting <br /> provides a full description of the reclamation work that still needs to be accomplished at the <br /> mine site, a statement of the amount spent by the Division on reclamation, and an estimate of <br /> the remaining costs of reclamation. <br /> The parties exchanged initial interrogatories based on the present complaint. These <br /> interrogatories were answered by the parties in March 1998. <br /> After providing the Third Party Plaintiffs with the accounting and answering <br /> interrogatories, the Division agreed to talk with them about any concerns they had with the <br /> Division's planned reclamation, especially for this year's reclamation.
