LaGiglia <br /> Creditors' Trustee under Bankruptcy Plan of Liquidation (collectively "MCR"), by thew attorneys <br /> Bums,Figa&Will, P.C., hereby object to Third-Party Defendant, Division of M'merals and Geology's <br /> ("DMG")Motion to Vacate Status Conference and Requirement of Submission of Proposed Case <br /> Management Order as follows: <br /> After being ordered on August 3, 1998 to work on a proposed case management order for <br /> submission by August 27,,1998 and to attend a fiuther status conference on August 28, 1998, DMG <br /> waited twenty-two (22) days until just three days before the further status conference to object to that <br /> status conference. DMG's eleventh hour motion is just an attempt to delay the orderly disposition <br /> of this case. <br /> As the basis for its Motion, DMG states that if this Court grants MCR's Motion to Amend, <br /> the claims will be substantially different and will require a different Case Management Order.
