reclamation has been completed. Once notice is given, the Division
would be willing to inspect the reclamation to see if it meets
applicable standards and, if it does, would be willing to release
the LLC from further reclamation obligations . In turn, the
Division would request a release from the LLC of any obligation of
the Division to reclaim the site.
Conclusion
The above discussion is intended to give a summary of the
complicated history of the Coal Basin mine site . The Division has
performed reclamation effectively and efficiently to date . In
addition, the Division has previously made substantial efforts and
provided substantial information and even site visits to resolve
reclamation issues with MCR and the Trustee. The Division believes
it is in the best interests of all the parties that this matter be
resolved so that completion of reclamation can move forward. The
Division hopes this letter is a helpful overview of this case . The
Division will be happy to provide any further information you may
want or require concerning this matter, and very much appreciates
any guidance you can provide in resolving this case .
`Sincerely,
jL (mot
CHERYL LINDEN
First Assistant Attorney General
Natural Resources and Environment Section
Telephone (303) 866-5127
FAX: (303) 866-3558
27
