("MCR") is a <br /> corporation that has done business in the state of Colorado, that MCR is both a Defendant <br /> and a Third-Party Plaintiff, that MCR petitioned for relief in bankruptcy, and that its assets, <br /> and liquidation thereof, are controlled by a bankruptcy plan of liquidation. <br />
