2-21-95 <br /> MEMO TO FILES <br /> Spoke with Larry Routten today regarding Mine 5 reclamation <br /> requirements. I was specifically interested in where the material <br /> to be moved which was included in the cost estimate was located, <br /> and whether it made sense to rehandle the material if it turned out <br /> to be stable or otherwise reclaimed. Larry said that the material <br /> included in the cost estimate was located below the 5 mine <br /> pond. Larry stated, and he said that Tony Waldron agreed that this <br /> material was pre-law. Larry and Tony said that there was a fairly <br /> clear documentation of this. I said that I would remove this job <br /> from the cost estimate as it was pre-law. Further, this is the <br /> site of an AML project which was done two years ago. <br /> Larry said that the stream channel above the 5 mine pond north of <br /> the lower mine bench slopes had been relocated by Mid-Continent <br /> Resources. They apparently placed a dike in the channel to route <br /> it further north. Larry thought that MCR retained liability to <br /> divert the stream into its pre existing channel. This is the <br /> design work that David Berry is working on currently. This cost <br /> should be contained in the cost estimate. <br />
