The Board again pc'"Sstponed the meting to discuss <br />reclamation, and modified the Schedule, extending the date of <br />commencement of reclamation from June 1, 1992 to August 3, 1992. <br />In July 1992, the potential buyer backed out. At the next <br />Board meeting, in late August 1992, the Division recommended that <br />Resources' permit be revoked and that the operator be ordered to <br />conduct reclamation in accordance with the Schedule contained in <br />0 <br />the May, 1991 Board Order. After listening to the Division's <br />recommendation, the Board revoked the permit and ordered <br />compliance with the May 1991 Schedule, but only upon the express <br />instruction that modifications to the Schedule were to be agreed <br />upon between the Division and Resources. See p. 17 of Board <br />Minutes dated August 26 -27, 1992, attached as Attachment F to <br />Defendants' Reply Brief in Support of Motion for Summary Judgment. <br />The Board did not execute a written order making its decision <br />at the August 1992 Board meeting effective until October, 1992. <br />When that order was signed by the Board in October, it was left <br />undated.
