-3- <br />SCHEDULE TO NOTICE OF VIOLATION <br />Notice of Violation No.: CV- 2012 -004 <br />NATURE OF VIOLATION: <br />Failure to transport and place coal mine waste to prevent mass movement. Failure to prevent drainage <br />from flowing over the outslope of the fill. Failure to divert surface runoff from the fill surface to <br />stabilized channels off the fill which will safely pass the runoff from a 100 year, 24 -hour precipitation <br />event. <br />ACT, REGULATION, OR PERMIT PROVISION(S) VIOLATED: <br />ACT SECTION(S): <br />REGULATION SECTION(S): 4.05.3(1)(e), 4.09.1(1)(c), 4.09.2(5), 4.09.2(7), 4.10.3(2) and 4.10.3(3) <br />PERMIT SECTION(S): Volume IX, Coal Mine Waste Disposal Area No. 2 and 4, page 9; Volume IX, <br />Figure 2 — Coal Mine Waste Disposal Area Drainage Plans. <br />PORTION OF THE OPERATION TO WHICH THIS NOTICE APPLIES: <br />Gob Pile No. 4. Coal mine waste (CMW) stacked near the outslope of Gob Pile No. 4 for the purpose of <br />drying before compaction has flowed over the outslopes and blocked Ditches D -D8, D -F 1 and D -D3. <br />Run -off from the top of the Gob Pile No. 4 has flowed over the top and caused erosion on the sideslopes. <br />STEPS NECESSARY TO ABATE VIOLATION (REMEDIAL ACTION): <br />Remove the coal mine waste from the edge of the outslope of Gob Pile No. 4, remove the CMW that <br />flowed down the outslope of Gob Pile No. 4, restore all lateral ditches on the outslope of Gob Pile No. 4 <br />and restore collection ditch D -D3. <br />TIME FOR ABATEMENT (NOT MORE THAN 90 DAYS): <br />ON OR BEFORE <br />NOV FORM (3/95) <br />WHITE - File <br />May 18 , 2012. <br />YELLOW - Operator PINK - Specialist <br />
