<br />EXHIBIT A - Legal Description
<br />The affected land is located in Jefferson County, Colorado, in Section 25 of Township 2 South, Range 71
<br />West, 6 Principal Meridian. The affected or potentially affected areas have changed from the previous
<br />permit amendment application (Amendment 3). Amendment 3 proposed an expansion of the affected or
<br />potentially affected areas by 14.83 acres to accommodate anticipated mitigation and monitoring activities.
<br />Approval of Amendment 3 would result in a total area covered under mine reclamation permit M- 1977 -300
<br />of 61.16 acres. This amendment application (Amendment 4) covers further expansion of the total area
<br />under mine reclamation permit M- 1977 -300 by 3.0 acres, as shown in Table A -1 (below) and in the maps
<br />in Exhibit C, to accommodate potential dnlling from the surface into mined out portions of the 700 Level in
<br />order to provide remote access to the mine pool for remedial purposes as described in Exhibit E, and to
<br />accommodate potential pipeline infrastructure to convey pumped mine pool water to a relocated water
<br />treatment plant. With the addition of Tracts A -1 and A -2, the acreage associated with Permit No.
<br />M- 1977 -300 will be 72.77 acres.
