with a final order of the Court entered pursuant to SS 303, 331, or
503(b) (2) through (6) of the Bankruptcy Code.
The following summarizes the legal fees and expenses
accrued to date in connection with the Debtor's bankruptcy case:
(i) the Debtor's bankruptcy counsel, Holden & Jessop,
P.C. , has been allowed interim fees and expenses of
$163,503.93 from the inception of the case through
September 30, 1993, of which $121,425.72 has been paid
pursuant to Court order. From October 1, 1993 through
December 31, 1993, the firm has accrued $26,242.57 of
fees and expenses which have not yet been submitted to
the Court for allowance; together with fees and expenses
previously allowed but not paid, the firm thus claims
$68,320.78 of unpaid fees and expenses through 1993.
Through Plan confirmation, the firm estimates that this
amount may increase to $90,000;
(ii) the Debtor's special counsel, Sherman & Howard, has
been allowed final fees and expenses of $47,642.05. The
firm has received no prior payment of fees incurred in
this case;
(iii) the Debtor's special counsel, Delaney and Balcomb,
P.C. , has been allowed interim fees and expenses of
$38,254.03 from the inception of the case through March
31, 1993. The firm has applied for allowance of
additional fees and expenses of $10,977 for the period of
April 1 through September 30, 1993; these applications
remain pending. To date, the firm has received payment
of $36,420.75 on these applications. Thus, through
September 30, 1993, the firm claims $12,810.28 of unpaid
fees and expenses. Fees and expenses accrued since
September 30, 1993 and through confirmation of the Plan
are anticipated to be insubstantial; and
(iv) Fairfield and Woods, P.C. , counsel for the
Creditors' Committee, has been allowed interim fees and
expenses of $17,427.34 from the inception of the case
through July 31, 1992, of which $13,314 .84 has been paid.
From August 1, 1992 through December 31, 1993, the firm
has accrued an additional $34,625.07 of fees and
expenses. The firm estimates an additional $5,000 of
fees and expenses through confirmation of the Plan, which
would leave an unpaid balance of approximately $44,000 at
Plan confirmation.
Total professional fees and expenses in the case thus are
estimated at approximately $365,000 through confirmation of the
Plan. Of this amount, approximately $140,000 has been paid by the
Debtor as a result of advances from Mid-Continent Minerals. These
