underground storage tanks, PCB-contaminated items, or other <br /> hazardous substances, and monitoring and treatment of water <br /> discharging from the mine, required with respect to any property <br /> owned by the Debtor, including the Mine Site, the Carbondale <br /> Industrial Park, and the Fabrication Shop, until such time as such <br /> property is sold. <br /> 1. 17 Fabrication Shop shall mean the parcel referred to <br /> on the Debtor's Schedule A as the "Carbondale Mine Services Tract. " <br /> 1. 18 Final Order shall mean an order of the Court as to <br /> which (a) the time for appeal has expired and no notice of appeal <br /> has been filed; (b) no stay as provided by Rule 8005 of the Federal <br /> Rules of Bankruptcy Procedure has been issued with respect to any <br /> timely filed appeal; or (c) any timely filed appeal in which a stay <br /> has issued has been finally determined or dismissed. The time for <br /> appeal, for purposes of this definition, shall be the time <br /> permitted for an appeal to the United States District Court. <br /> 1. 19 M&E shall mean Machinery & Equipment Company, Inc. , <br /> a California corporation, and A. M. Ring Industries, Inc. , a Nevada <br /> corporation, jointly and severally and as joint venturers. <br /> 1.20 M&E Contract shall mean the contract between the <br /> Debtor and M&E approved by the Court on August 13, 1992. <br /> 1.21 Marblehead Ouarry shall mean the parcel referred to <br /> on the Debtor's Schedule A as the "Marblehead Quarry Claims. " <br /> 1.22 Mid-Continent Ouarry shall mean the unpatented <br /> mining claims leased from CF&I Steel Corporation pursuant to a <br /> lease agreement dated April 12, 1982. <br /> 1.23 Minerals shall mean Mid-Continent Minerals, Inc. , <br /> the Debtor's parent corporation. <br /> 1.24 Mine Site shall mean parcels referred to on the <br /> Debtor's Schedule A as the "Coal Basin Fee Coal Land Surface, " the <br /> "Coal Basin Coal Preparation Plant Area, " the "Coal Basin Sutey <br /> Property, " the "Coal Basin Patent Property, " and the "Carbondale <br /> Rail Loadout Tract, " comprising the Debtor's coal mine facility <br /> located in Pitkin, Gunnison, and Garfield Counties, Colorado, <br /> together with offices and train load out facility located in <br /> Carbondale, Colorado. <br /> 1.25 MLRB shall mean the Colorado Mined Land Reclamation <br /> Board. <br /> 1.26 Net Proceeds shall mean the cash proceeds of <br /> property sold under the Plan, after payment of reasonable fees, <br /> commissions, title insurance, advertising expenses, property taxes, <br /> or similar costs of sale and, with respect to the Creditors' Trust, <br /> 3 <br />
