EMERSON ,HODGES3GREEN TEL N0 .303-963-0985 Feo 22 ,94 16 : 15 No .007 P .02/02
4
R
Mr. John Holden
February 22, 1994
Page 2
can society of Testing Materials apply to environmental clean-up.
The Town is willing to attempt to arrive at a more specific
definition of the standards that apply for remediation, but the
Town's position remains the same in that it will require that the
clean-up be to all standards imposed by federal and state regula-
tory agencies that have jurisdiction. In addition, the Town
wants all petroleum-saturated soil removed and replaced. I would
be happy to work with you to see if acceptable language for the
contract can be reached.
The Town's goal is to enter into a contract that is fair to both
parties and which can be presented to the bankruptcy court for
approval so that the contract is binding on the bankruptcy
estate. The Town cannot be in a position to have a contract that
can be set aside at the last minute in the bankruptcy process.
We would like to work with you to see if this goal can be
reached.
sincerely,
ROBERT B. EMERSON, P.C.
Robert B. Emerson
RBE/jc
cc: Davis Farrar
