Agent. Upon execution hereof, Purchaser shall make an earnest <br /> money deposit of Ten Thousand Dollars ($10,000.00) with Stewart <br /> Title, to be held by the Closing Agent until closing. Upon <br /> closing, accrued interest shall be paid to Seller, and if closing <br /> does not occur shall be paid to Purchaser. Purchaser and Seller <br /> shall pay their respective customary closing costs at closing and <br /> shall sign and complete all customary or required documents at or <br /> before closing. Fees for real estate closing and settlement <br /> services shall no exceed Two Hundred Dollars ($200 .00) and shall be <br /> paid at closing, one-half (�) by Seller and one-half (�) by <br /> Purchaser. The balance of purchase price shall be paid in good <br /> funds at closing. <br /> 4 . Seller shall furnish to Purchaser at Seller's expense a <br /> current commitment for owners' title insurance policy in an amount <br /> equal to the purchase price on or before March 15, 1994. Copies of <br /> instruments listed in the schedule of exceptions in the title <br /> insurance commitment which are recorded shall be furnished to <br /> Purchaser at Seller's expense. The title insurance policy will be <br /> delivered to Purchaser as soon as practicable after closing. <br /> 5. a. After the title commitment and accompanying docu- <br /> ments are delivered to Purchaser, Purchaser shall <br /> give written notice of unmerchantability of title <br /> or any other unsatisfactory title condition shown <br /> by the title documents signed on behalf of Purchas- <br /> er and given to Seller on or before fifteen (15) <br /> calendar days after Purchaser's receipt of title <br /> documents or within five (5) calendar days after <br /> receipt by Purchaser of any title documents or <br /> endorsements adding new exceptions to the title <br /> commitment, together with a copy of title documents <br /> adding new exceptions to title. If Seller does not <br /> receive Purchaser's notice by the date specified <br /> above, Purchaser shall be deemed to have accepted <br /> the condition of title as disclosed by the title <br /> documents as satisfactory. <br /> b. Seller shall deliver to Purchaser on or before <br /> March 15, 1994, copies of all leases and surveys in <br /> Seller's possession pertaining to the property and <br /> shall disclose to Purchaser all easements, liens or <br /> other title matters not shown by the public records <br /> of which Seller has actual knowle!-e. Purchaser <br /> shall have the right to inspect the property to <br /> determine if any third party has any right in the <br /> property not shown by the public records (such as <br /> an unrecorded easement, unrecorded lease, or bound- <br /> ary line discrepancy) . written notice of any <br /> unsatisfactory condition disclosed by Seller or <br /> revealed by such inspection shall be signed on <br /> behalf of Purchaser and given to Seller on or <br /> 2 <br />
