Seller will be specifically authorized to sell the property <br /> to Buyer WHERE IS AS IS. <br /> IX. <br /> MISCELLANEOUS: <br /> This Agreement when executed by the parties shall be <br /> binding upon them excepting only Buyer's right to refuse to <br /> close in the event any of the property has been removed from <br /> the Carbondale site or has been destroyed. This Agreement is <br /> binding upon and shall inure to the heirs, successors, and <br /> assigns of the parties hereto. This Agreement represents the <br /> final Agreement of the parties and there are no other oral or <br /> collateral agreements of any kind or character except as <br /> expressly set forth herein. Time is of the essence. <br /> X. <br /> STORAGE OF PROPERTY: <br /> Buyer shall remove the equipment outside of the <br /> buildings and outside of the bins, including all conveyors <br /> within six months of closing. The additional equipment <br /> hereby sold shall be removed by Buyer within one year of <br /> closing and items not so removed can be removed by Seller, <br /> charging the cost of removal , plug 15e back to Buyer and <br /> Seller may dispose of the items so removed as scrap. <br /> Notwithstanding the foregoing, however, Buyer shall. not <br /> be responsible to remove any hazardous waste, transformers, <br /> oil drums, 55 gallon barrel drums or other storage containers <br /> of hazardous waste and/or solid or liquid materials or <br /> 4 of 5 <br />
