N ) <br /> NOTICE PURSUANT 'TO LOCAL BANKRUPTCY RULE 202 <br /> OF MOTION FOR AUTHORIZATION TO SELL CARBONDALE INDUSTRIAL PARK <br /> FREE AND CLEAR OF INTERESTS OF ENTITIES OTHER THAN THE ESTATE <br /> TO PARTIES IN INTEREST: <br /> NOTICE IS HEREBY GIVEN that the above-named Debtor has applied to this <br /> Court for authorization to sell real property known as the "Carbondale <br /> Industrial Park, " free and clear of any interest in such property of entities <br /> other the estate with the exception of real estate taxes and a $7, 000 lien in <br /> favor of the Colorado Mined Land Reclamation Board. A copy of the Motion is <br /> attached hereto. <br /> The sale price for the property is $1,231,000, subject to any higher and <br /> better offers. Proceeds of sale will be used to pay (i) property taxes, in <br /> the approximate amount of $185,477.47; (ii) costs of sale, including closing <br /> costs and costs of an environmental audit and any environmental remediation of <br /> the property, which are not anticipated to exceed $35,000; and (iii) a senior <br /> lien in favor of the Colorado Mined Land Reclamation Board in the amount of <br /> $7,000. The balance of sales proceeds would be used to make distributions <br /> pursuant to the chapter 11 Plan confirmed in this case, with the balance to be <br /> turned over to the Creditors Trust for distribution pursuant to the Plan. <br /> Pursuant to Rule 202 of the Local Rules of Bankruptcy Procedure, if you <br /> desire to oppose this action you must file a written objection and request for <br /> a hearing with the Court on or before June 27, 1994, and serve a copy thereof <br /> on the undersigned attorney at the address noted below. Objections and <br /> requests for hearing shall clearly specify the grounds upon which they are <br /> based, including the citation of supporting legal authority, if any.
